City of Lockport Draft Local Waterfront Revitalization Program

PURSUANT to Article 42 of the New York State Executive Law and 19 NYCRR Part 601, the New York State Department of State (DOS) has received and accepted a Draft Local Waterfront Revitalization Program (LWRP) for the City of Lockport.

To approve this LWRP, the Secretary of State must find that it is consistent with Article 42 of the Executive Law and that it does not conflict with existing state programs and policies. Since state agency actions must be consistent with an approved LWRP, Article 42 requires that the public and any potentially affected state agency be given the opportunity to comment on the proposed program.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.

The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

In F-2009-0234, the Central Hudson Gas & Electric Corporation (CHGE) is seeking approval from the U.S. Army Corps of Engineers, New York District, for the remediation of contaminated sediments at the former CHGE site in and along the Hudson River, located on South Water Street, City of Newburgh, Orange County.

The proposed remediation activities are being undertaken in response to a NYSDEC Order on Consent (Index# D3-0001-95-06) as part of the December 2005 Record of Decision for the site (Site #3-36-042), issued by the NYSDEC and the U.S. Environmental Protection Agency (USEPA) for the containment and removal of non-aqueous phase liquid (NAPL) coal tar from the upland portion of the project (area B), and the removal of ~26,000 cy of NAPL and polycyclic aromatic hydrocarbon (PAH) impacted sediments from within the river (area C). Area A, as identified in Site #3-36-042, was previously completed between November 2006 to August 2007. The dredged sediments will be processed and transported off-site for treatment and disposal. All disturbed areas will be restored using clean fill, re-graded and replanted. Some of the specifics of the project include:

At Area B •Installation of a steel sheeting barrier wall and construction of a gravel filled collection trench along the bank of the Hudson River to contain and collect NAPL coal tar. The barrier wall will be installed at elevation 2.5 feet above mean sea level, which equates to the mean high water (MHW) level of the Hudson River at the site location. The collection trench will drain into a series of sumps to allow for periodic collection and removal of the NAPL. •Construction of a temporary stone access road, temporary material and equipment staging areas, sediment handling area, an equipment decontamination area, and temporary removal of rip-rap along the shoreline to facilitate barrier wall installation and sediment removal activities.

At Area C •Removal of debris and sunken barge located at the site, prior to dredging. •Installation of a steel sheeting cofferdam to isolate the NAPL impacted sediment removal area and to provide turbidity control. •Employment of turbidity curtains placed around the exterior perimeter of the cofferdam. •Installation of A king-pile system for excavation support in areas of deep dredging/removal. •Dredging of the NAPL impacted sediments performed in the wet using mechanical dredging equipment. •Amendment of sediments, as necessary, on-site with subsequent transport off-site for treatment and disposal. •Dredging of PAH impacted sediments from a one (1) acre area outside of the cofferdam, processed as appropriate and transported off-site for treatment and disposal. •Employment of turbidity curtains to contain resuspension of PAHs.

At Areas B & C •Site Restoration activities will include: placing select fill materials within excavated bank areas to restore the ground surface; backfilling the dredged areas to approximate pre-remediation grades; restoring the existing rip-rap-lined shoreline area; revegetating disturbed areas within the site; restoring surface features that may be disturbed or damaged; and decontamination of equipment.

The applicant has certified that Best Management Practices (BMP) and Engineering Controls will be used at all phases of the project. An Erosion and Sediment Control Plan has been developed, and a temporary water treatment system will be constructed to control any waste streams generated during remediation activities. Surface water monitoring, turbidity monitoring and air quality monitoring will be conducted to ensure proper containment of contaminants.

Any interested parties and/or agencies desiring to express their views concerning the above proposed activities may do so by filing their comments, in writing, no later than 4:30 p.m., 15 days from the date of publication of this notice, or, July 30, 2009.
