The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.

The United States Army Corps of Engineers - New England District (Corps), has determined that the proposed activity will be undertaken in a manner consistent to the maximum extent practicable with the enforceable policies of the New York State Coastal Management Program. The applicant's consistency determination and accompanying supporting information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

In F-2011-1010 (DA) the Corps proposes to implement the removal and closure of aboveground and underground fuel storage tanks, associated piping and venting, contaminated soil (if encountered), and electrical transformers at the following two Formerly Used Defense Site (FUDS): Former Fort Tilden, Rockaway Beach, Queens; and Swinburne Island, Staten Island. They are part of the Gateway National Recreation Area, which is owned and managed by the Department of the Interior, National Park Service.

The New York State Department of State (DOS) is required by Federal law to provide timely public notice for the activity described below, which is subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.

The United States Environmental Protection Agency, has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

In F-2011-1041 DA, the U.S. Environmental Protection Agency has published for review, two draft National Pollutant Discharge Elimination System (NPDES) permits for discharges “incidental to the normal operation of vessels.” If finalized, the re-issuance of the Vessel General Permit (VGP) would authorize discharges “incidental to the normal operation” of non-military and non-recreational vessels equal to or greater than 79 feet in length and would replace the current VGP issued in December 2008 and expiring on December 18, 2013. The proposed draft Small Vessel General Permit (sVGP) would authorize discharges “incidental to the normal operation” of non-military and non-recreational vessels less than 79 feet in length. These permits will apply to the waters “of the United States,” defined as those waters extending to the outer reach of the 3 mile territorial sea, as defined in section 502(8) of the CWA.

PUBLIC NOTICE New York State Department of State Notice of Review for the Town of Clay Draft Local Waterfront Revitalization Program

PURSUANT to Article 42 of the New York State Executive Law and 19 NYCRR Part 601, the New York State Department of State (DOS) has accepted a Draft Local Waterfront Revitalization Program (LWRP) for the Town of Clay, located within Onondaga County. The LWRP serves as a comprehensive management program for the Town’s waterfront resources along the Seneca River, Oneida River, and the Erie Canal.

To approve the Town of Clay LWRP, the Secretary of State must find that it is consistent with Article 42 of the Executive Law and that it does not conflict with existing state programs and policies. Since state agency actions must be consistent with an approved LWRP, Article 42 requires that the public and any potentially affected state and regional agencies be given the opportunity to comment on the proposed program. For this purpose, Clay’s draft LWRP is available online at http://nyswaterfronts.com/LWRP.asp.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.

In F-2011-0742, the applicant - Shinnecock Tribe - as the Shinnecock Tribal Oyster Project, has certified that the proposed shellfish aquaculture activit(ies) comply with and will be conducted in a manner consistent to the maximum extent practicable with the New York State Coastal Management Program. The applicant's federal consistency certification and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

The applicant proposes deployment of eighty-one (81) cages (dimensions 32"W x 36"L x 4' H) to be situated on the soft bottom substrate and submerged aquatic habitat of Shinnecock Bay and twenty-five (25) floating stringer units (22"W x 22" L x 8"H) at the surface with 4" plastic floats attached, each consisting of twenty (20) shellfish containers per line. The cage structure(s) are proposed to be located in the subtidal zone (open water, always submerged). The species to be cultivated include Eastern oyster (Crassostrea virginica) and hard clams (Mercenaria mercenaria) with future possible cultivation of soft clams (Mya arcnaria) and bay scallops (Argopecten irradians). The cultivation constitutes a commercial, water dependent use providing economic benefit to the Shinnecock.

According to the information provided to the Department of State, the on-bottom and off-bottom equipment will be deployed within 500 feet of the low tide watermark on the western side of the Shinnecock Indian Reservation at two locations designated Area A and Area B. Area A consists of 21 acres of underwater lands at Cuffee Beach (directly adjacent to reservation lands) and Area B consists of 8.3 acres of underwater lands at Heady Creek (also directly adjacent to reservation lands). The applicant's right to use the underwater lands and the overlying water column at these sites is based upon a claim of ownership to these same underwater lands by the Shinnecock Nation. The applicant indicates that documentation of ownership is presently on file with the New York State Department of Environmental Conservation (NYSDEC). Application necessary for review of the proposal and issuance of aquaculture permits has been submitted to the NYSDEC.

The material is proposed to be disposed of at the open lake disposal site in Lake Ontario.

The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the federally approved New York State Coastal Management Program. In application F-2008-0753, United Water New York, Inc, is proposing the Haverstraw Long Term Water Supply Project (Project) in the Town of Haverstraw, Rockland County. The Project includes the development and operation of a new water intake, intake pumping station, water treatment and desalination facility, and transmission mains. The proposed facility would withdraw up to 10 million gallons of water per day (MGD) from the Hudson River within Haverstraw Bay through an approximately 900’ pipeline, to be installed via micro tunneling, and an intake structure fitted with 0.5 millimeter slot width wedgewire screens with a maximum approach velocity of 0.25 feet per second. The water would then be treated and desalinated via filtration and reverse osmosis and enter United Water’s transmission and distribution system. Following onsite pretreatment, the effluent (except a concentrated brine solution) generated by the Project facility would be transported via pipeline to and treated at the Haverstraw Joint Regional Sewage Treatment Plant (HJRSTP). The above referenced concentrated brine solution would then be separately combined with the treated effluent from the HJRSTP and ultimately discharged back to the Hudson River in Haverstraw Bay.

The stated purpose of the proposed action is to “develop an additional sustainable water supply that will increase the safe yield of the [United Water New York] system to meet the growing needs for water in Rockland County over the next 20 years.”

The WLIS is located within Long Island Sound, approximately 2.8 nautical miles south of Long Neck Point, Noroton, CT and the CLIS is located within Long Island Sound, approximately 5.6 nautical miles south of East Haven, CT.
