The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.

In F-2010-0584, the United States Department of the Navy is proposing bridge replacement and quaywall repairs at the Naval Operations Support Center Buffalo, on the Black Rock Canal in the City of Buffalo, Erie County, New York. Specifically, the proposed activity involves:

• the removal of a two span concrete and steel truss bridge and replacement with a single span steel truss bridge approximately 10 feet longer than the original;
• construction of a new steel H-pile and concrete lagging panel in front of the existing stone masonry quaywall;
• placement of a 190-foot long fixed or floating dock secured by approximately 5-10 timber piles;
• construction of a concrete block retaining wall;
• construction of a rip-rap quaywall support embankment;
• access pier and gangway installation;
• jet dock electrical power supply;
• grouting of north end quaywall foundation;
• shoring of the north end quaywall masonry;
• replacement of timber fender wale and chock;
• replacement of the fender pile end cap; and
• miscellaneous repairs to a concrete quaywall on timber cribbing.

The United States Department of the Navy has determined that the proposed activity will be undertaken in a manner consistent to the maximum extent practicable with the enforceable policies of the New York State Coastal Management Program. The applicant's consistency determination and accompanying supporting information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.

The United States Department of Homeland Security, U.S. Coast Guard has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

In F-2010-0676 DA, the U.S. Coast Guard, is proposing to perform maintenance dredging of the boat basin moorings at the USCG Station Rochester boat basin, located at 5500 St. Paul Boulevard, and at the USCG Auxiliary Moorings Rochester, located at 520 River Street, within the Genesee River, City of Rochester, County of Monroe. The proposal involves the maintenance dredging of the mooring areas to the following dimensions:

•Mechanically dredge approximately 3,000 cubic yards (cy) of material from an approximately 40,600 square foot area of the USCG Station Rochester boat basin to a depth of 7 to 8 feet. This area is comprised of a 325’ x 120’ area immediately adjacent to the bulkhead, and a 20’ x 80 boat slip. •Mechanically dredge approximately 800 cy of material from an approximately 3960 square foot area of the USCG Auxiliary Moorings boat basin to a depth of 7 to 8 feet. This area is comprised of a 132’ x 30’ area immediately adjacent to the bulkhead.

The proposal as described, will remove up to 3800 cubic yards of material from within the USCG mooring areas. All material is proposed to be placed at the Lake Ontario open-water disposal site located approximately 1.5 miles northeast of the East Pier Light at Rochester Harbor.

The stated purpose of this proposal is to provide better access to the refueling areas and to correct difficulties in docking and launching boats due to insufficient depths. The riverbed is not currently at sufficient depth for the USCG search and rescue boats utilized by the USCG Rochester for maritime safety.

The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. In F-2010-0593, The Battery Park City Authority, One World Financial Center, New York, NY, has applied to the U.S. Army Corps of Engineers, New York District, for a permit to install a closed cycle river water heating and cooling system for their facilities (currently leased from the NYC Economic Development Corporation) at Pier A, 22 Battery Place, New York, NY. The proposed action would involve the installation, operation and minor maintenance of 2 clusters of 5 keel cooler arrays which would each measure 23 feet by 7.5 feet by 5 inches as well as other associated infrastructure. The proposed system would be positioned 4 feet above the mud line of the Hudson River and completely underneath the existing Pier A structure in approximately 17 feet of water.

The stated purpose of the above mentioned proposal is to “…provide for the heating and cooling of the Pier A building.”

In F-2010-0586, Aquifer Drilling and Testing, Inc. is proposing to drill eight marine borings for exploratory purposes in Haverstraw Bay on underwater lands owned by U.S. Gypsum and the State of New York in the Town of Haverstraw, Rockland County, New York. The borings are being installed to collect subsurface information for the design of a water intake line. Approximately eight borings will be drilled via a drill rig mounted on a barge. The four inch boreholes will extend approximately 100’ below the mudline into the Hudson River bottom. Boreholes will be grouted in-place via tremie pipe with cement-bentonite grout as the drill casing is removed from the borehole. The proposed activity will result in a total of approximately 3 cubic yards of fill. The area where the proposed borings will be drilled is within the State-designated Haverstraw Bay Significant Coastal Fish and Wildlife Habitat.

The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The United States Department of the Interior, Army Corps of Engineers - New York District (Corps) has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination, draft Environmental Assessment, and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

In F-2010-0796 (DA), the U.S. Army Corps of Engineers - New York District, is proposing work to expand the inlet dredging area at Mattituck Inlet within the Town of Southold, Suffolk County, New York. The proposed work would increase the existing channel footprint to -11 feet MLW in depth and would increase the channel width to obtain 90,000cy of material. An additional 10,000cy of material would be obtained from the updrift fillet within the public park know as Breakwater Beach. This 100,000cy of material for bypassing would be removed as a combined project under the Continuing Authority Program, Section 111 project and maintenance dredging under the Corps’ Operation and Maintenance Program. Future bypassing would occur every 9-10 years as a combined Section 111 Project and as a maintenance dredging project. The Section 111 study supporting the selected project alternative was conducted under the Corps of Engineers’ Continuing Authorities Program and was initiated based on a request from the New York State Department of Environmental Conservation (NYSDEC) concerned with erosion induced by the Federal Navigation Project at Mattituck Harbor, New York.

According to the information provided to the Department of State, the Corps has determined that the selected alternative is the best engineering solution and that implementation of the proposed Section 111 project will have significant beneficial impacts to the environment and surrounding communities including benefits to aquatic habitats and species, shorebird communities, improved downdrift shoreline stabilization and recreational opportunities, and reduced risk of storm damages due to the effects of the jetties.

The United States Department of Interior’s Fish and Wildlife Service, has determined that the proposed activity will be undertaken in a manner consistent to the maximum extent practicable with the enforceable policies of the New York State Coastal Management Program. The applicant's consistency determination and accompanying supporting information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

United States Department of Interior’s Fish and Wildlife Service, through their Partners for Fish and Wildlife program, proposes to reopen historic channels, allowing current to pass through the wetland, and connect upland inlets with Delaney Bay. Approximately 60 acres of monotypic cattail marsh will be restored or enhanced to provide spawning/nursery habitat for northern pike and habitat for wetland dependent birds. All restoration will take place in the marsh area using an amphibious excavator equipped with a ditching head. The ditching head is capable of restoring channels to a width of up to four feet wide – by two feet deep. While on site, appropriate channel bends will be enhanced with shallow “oxbow” areas with an approximate width of six to eight feet wide – by one foot deep. These oxbows will encourage re-vegetation and diversity in wetland plants at the site. The site is between Middle and Rusho Bay Roads on Grindstone Island. The excavator will be refueled on the upland and spill containment pads will be utilized during refueling. Suny-ESF will monitor the site as part of their ongoing assessment of the Conservation Strategy for the St. Lawrence River. The work is proposed for the fall.

All spoils will be side-cast from 0-30 feet in a relatively uniform fashion, with no apparent change in existing elevation. The excavator will be refueled on the upland and spill containment pads will be utilized during refueling. Suny-ESF will monitor the site as part of their ongoing assessment of the Conservation Strategy for the St. Lawrence River. The work is proposed for the fall.

In F-2010-0780 DA, the U.S. Army Corps of Engineers - New York District, is proposing to perform maintenance dredging of the existing federal navigation channel known as the South Brother Island Channel Reach of the East River, Borough of Queens, Queens County.

The proposal involves the maintenance dredging of the 35 ft. deep (with an allowable 2 ft. overdepth) and 400 ft. wide channel, with widening at the junction with the main channel, and a turning basin at the head of the channel, for a total length of 1.3 miles. The proposal as described, will remove approximately 300,000 cubic yards of material to be placed at the Historic Area remediation Site (HARS). The dredging and material placement at the HARS is anticipated to be completed this fall and winter.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.

In F-2010-0157, The Town of Clarkstown, proposes to construct a drainage improvement project in the hamlet of Central Nyack and is proposed to include upgrades to the existing storm drainage system as well as the construction of a 45 acre foot impoundment generally bounded by Schuyler Rd on the west, Vine street on the north, the Village of Nyack on the west and the Town of Clarkstown town line on the south. The 45 acre foot impoundment requires the construction of a 14 foot high earth dam and impacts approximately 3 acres of U.S. Army Corps of Engineers regulated wetlands which are proposed to be mitigated by the establishment of 3 acres of constructed wetlands.

The project is designed to retain stream flow, that drains approximately 198 acres of parkland, during a range of storm events and convey storm runoff from approximately 47.19 acres of residential area into the aforementioned stream, downstream of the proposed impoundment.

The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program.
